Delhi HC Grants GSP Crop Permission to Produce and Sell CTPR in India
GSP Crop Science Pvt Ltd. produces a broad variety of "technical" and "formulations" insecticides, fungicides, herbicides, and plant regulators.
Chlorantraniliprole (CTPR), an insecticide product, can now be manufactured and sold in India by GSP Crop Science, a market leader in the agricultural industry. The Honourable Delhi High Court refused FMC's request for a temporary restraining order in CS (Comm) 662/2022 (FMC Corporation vs. GSP Crop Science) on November 14, paving the way for GSP to introduce its CTPR product.
The Court declared IN'004 (the contested patent) to be prima facie invalid due to prior claiming, and it then assessed FMC a cost of Rs. 2,000,000 for its efforts to maintain its monopoly and for the numerous material omissions and misrepresentations it made to the Court and the Patent Office. With this new strategy, GSP Crop will produce and market CTPR as part of the Make in India Initiative, which will benefit both farmers and buyers in general.
FMC Corporation, USA and its two group companies, FMC Agro Singapore Pvt Ltd and FMC India Pvt Ltd, filed the lawsuit against Ahmedabad-based GSP Crop Science Ltd., seeking, an injunction restraining the infringement of Indian Patent No. IN252004 titled "Method for Preparing Fused Oxazinones from Ortho-Amino Aromatic Carboxylic Acid and a Carboxylic Acid in the presence of a Sulfonyl Chloride and Pyridine.” The FMC Group are engaged in the production, promotion, and sale of chemicals, including agrochemicals.
By suppressing all Lepidoptera and other species, Chlorantraniliprole (CTPR) provides an efficient and long-lasting pest control in crops including sugarcane, rice, soybean, legumes, and vegetables. On touch, it is poisonous to insect eggs, larvae, and pupae as well. CTPR efficiently penetrates plants from root to stem and has good bottom-up intake and transport in plants.
